When you opt in to our SMS messaging program, you agree to receive recurring text messages from MetaKizz, a brand of Virtual Flow LLC. Messages may include: • Class, masterclass, and event reminders • Promotional offers, new course launches, and special events 5.2 How you opt in. You opt in by submitting your phone number through our chat widget on https://metakizzproject.com, by sending a START message to our number, or by checking a clearly labeled SMS consent box on a registration form. Consent to receive marketing text messages is not a condition of any purchase. 5.3 Message frequency. Message frequency varies based on your activity. You may receive up to 10 messages per month under typical use, although frequency may be higher during active class enrollments or events. 5.4 Message and data rates. Message and data rates may apply. Charges from your wireless carrier are your sole responsibility. Please consult your wireless plan for details. 5.5 Opt-out. You may opt out at any time by replying STOP to any message you receive from us. After you reply STOP, you will receive a single confirmation message and no further messages will be sent. We do not sell, rent, share, or otherwise disclose your mobile phone number, SMS opt-in data, or text message content to any third parties for their marketing or promotional purposes. Information about your participation in the SMS program is shared only with our service providers who help us operate the program (e.g., our messaging platform), under contractual obligations to maintain confidentiality. 6. Purchases, Payments, and Billing Prices for courses, memberships, and events are listed on the Site and are subject to change. By placing an order, you authorize us (or our payment processor) to charge the payment method you provide for the total amount, including applicable taxes. Subscriptions renew automatically at the then-current rate until you cancel. You may cancel from your account dashboard or by emailing us. Cancellations take effect at the end of the current billing period. 7. Refund Policy Unless otherwise stated for a specific product: • Digital courses and memberships: non-refundable once access has been granted, except as required by applicable consumer-protection law. • Live events and festivals: governed by the cancellation policy disclosed at the time of purchase. • Defects or non-delivery: if you experience a technical issue that prevents access, contact us within 14 days and we will resolve the issue or issue a refund at our discretion. 8. "MetaKizz," the MetaKizz logo, and "Metakizz Project" are trademarks of Virtual Flow LLC. 11. Health and Safety Disclaimer Dance is a physical activity. By participating in our Services, you acknowledge that you do so at your own risk. Consult a qualified physician before starting any new physical activity, especially if you have a preexisting condition. Virtual Flow LLC is not liable for any injury, loss, or damage arising from your participation, to the maximum extent permitted by law. 12. Disclaimers THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. 13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIRTUAL FLOW LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. 14. Indemnification You agree to defend, indemnify, and hold harmless Virtual Flow LLC and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your violation of any law or third-party right. 15. Termination We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive. 16. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the exclusive jurisdiction of those courts. 17. Changes to These Terms We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Last Updated" date. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. 18. Miscellaneous If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver.
